Artificial Intelligence and Machine Learning Terms
As part of the AI Features, you will enter information into the provided chat box (the “Input”) and receive information (the “Output”). By enabling the AI Features, you signify your assent to these Artificial Intelligence and Machine Learning Terms (the “Terms”). If you do not agree to the Terms, do not enable the AI Features. CAST reserves the right, at its discretion, to change, modify, add, or remove portions of the Terms at any time. Users are responsible for periodically checking the Terms for changes. Usage guidelines for the AI Features are bound by these Terms.
User Acknowledgements
By enabling and using the AI Features, you acknowledge that:
- AI Features should not be relied upon exclusively, User discretion is required;
- AI Features may not generate accurate Output and/or Output may be out of date. Users understand that they must independently verify responses or advice provided by the AI Features. CAST does not warrant and expressly disclaims any warranties or guarantees relating to the accuracy of any Output provided by the AI Features;
- AI Features are subject to modification and alteration;
- The use of AI Features may: (i) generate unexpected Output, (ii) result in loss of Input and/or Output, or (iii) result in other anticipated or unanticipated damage or loss of Input and/or Output. Users understand and agree that CAST will not be liable in any way from the use or reliance on the Output generated from the AI Features;
- CAST does not warrant the uninterrupted operation of the AI Features or access and operation free from all error, nor that all of the deficiencies or errors which may be contained in the AI Features will be corrected; The AI Features are not guaranteed and are provided by CAST on an AS IS basis;
- Users are solely responsible for any and all Input which they submit in their use of the AI Features. Users should consider carefully before submitting any Input to ensure that it does not include any confidential information, proprietary information, trade secret, personal data, protected health information, or any otherwise sensitive information in their use of the AI Features and their Input.
- CAST has the right to disable the AI Features if the User uses them in an unreasonably excessive manner.
- CAST’s provision of the AI Features are subject to the OpenAI Business Terms available at https://openai.com/policies/business-terms.
CAST’s Use of User Input
CAST may use your Input to improve CAST Highlight, including:
- Providing your queries and prompts to third-party LLMs (notably ChatGPT) to generate responses;
- Understanding your use of the AI Features to generally improve the AI Features and how it interacts with CAST Highlight; and
- Possibly use or disclose your Input to comply with applicable laws, enforce these Terms and any other terms and conditions applicable to your continued use of CAST Highlight, and to detect and prevent fraud, security, or technical issues.
In the event that a User requests the AI Features to be enabled, the User expressly grants, and represents and warrants that they have all rights necessary to grant, to CAST a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, edit, translate, distribute, syndicate, publicly perform, publicly display, and make derivative works of all such Input, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with CAST Highlight, including without limitation in connection with modifying, improving, and enhancing artificial intelligence models, as well as promoting and redistributing part or all of CAST Highlight (and derivative works thereof) in any media formats and through any media channels.
Indemnity
You agree to indemnify, defend and hold CAST, its assignees, subsidiaries, affiliates and each of their respective officers, directors, employees, shareholders, agents and representatives, harmless at your own cost and expense from and against any and all liabilities, losses, damages, injuries, costs and expenses (including reasonable attorneys’ fees and costs), judgments and any amounts paid in any settlement (“Damages”) incurred as a result of or in connection with any third party claim which would not have arisen but for: (i) your failure to use the AI Features in accordance with these Terms and/or in accordance with the OpenAI Business Terms; and/or (ii) your gross negligence or willful misconduct in your use of the AI Features.
